1. About these terms
These terms apply when you buy goods from us as a consumer, whether online, by phone, by email or at our showroom. Please read them before you order. Business and trade customers buy on our separate trade terms, which are sent when a trade account is opened. Nothing in these terms affects your statutory rights.
2. Who we are
Bathurst & Co is a trading name of Reeve & Co (Bathrooms and Tiles) Ltd, a company registered in England and Wales under company number 07738560. Our registered office and showroom is at Stonham Road, Mickfield, Stowmarket, Suffolk IP14 5LS. Our VAT registration number is [CHECK: VAT registration number]. You can contact us on 01449 711782 or at hello@bathurstandco.co.uk.
In these terms, “we”, “us” and “our” mean Reeve & Co (Bathrooms and Tiles) Ltd, and “you” means the consumer buying from us.
3. Orders and acceptance
When you place an order you are offering to buy the goods. The contract is formed when we accept your order by email, not when you receive an automatic acknowledgement that the order has been received. [CHECK: point of acceptance used by the checkout, for example order confirmation or dispatch email]
We may decline an order, for example if an item is no longer available or the price shown was obviously wrong. If we do, we will tell you and refund anything you have paid.
Please check your order before you submit it. Choosing goods that suit your room and your water system is your responsibility, unless we have produced a design and schedule for you. Dimensions, water pressure requirements and fixing details are given on our product pages and specification sheets, and we will check a choice with you before you order if you ask.
Made-to-measure furniture from our joinery workshop, and any item made or altered to your specification, is made from drawings and dimensions you have approved in writing. Changes after approval may not be possible, or may be charged for. [CHECK: deposit and sign-off process for made-to-measure orders]
4. Prices and VAT
Prices on the website include VAT at the current rate. If the rate of VAT changes between your order and delivery, we will adjust the VAT you pay, unless you have already paid in full before the change takes effect.
Delivery charges are shown separately at checkout. Delivery to the Scottish Highlands, the islands and Northern Ireland, and installation, are quoted separately.
We check our prices, but errors can occur. If the correct price is higher than the price shown, we will contact you before accepting the order. If we have accepted an order at a price that was obviously wrong and you could reasonably have recognised it as an error, we may end the contract and refund what you have paid.
5. Payment
Payment is taken when you place your order. [CHECK: payment timing and any deposit arrangements] We accept [CHECK: accepted payment methods]. Online card payments are handled by our payment processor, and we do not receive your full card number.
6. Delivery
We deliver to addresses in UK mainland, and elsewhere in the UK by quotation. Delivery dates are estimates unless we agree a fixed date with you in writing. Unless we agree otherwise, we will deliver without undue delay and within 30 days of the contract being made, as the Consumer Rights Act 2015 requires. If we cannot, we will tell you, and your rights to agree a new date or to end the contract are those set out in that Act.
You must give us accurate delivery and access details. If a delivery cannot be made because nobody is there to receive it, or because access is not as you described, we may charge for a second attempt. [CHECK: failed delivery charge] Our delivery page explains how larger items are delivered and what we need to know.
Please check the goods when they arrive and report damage or shortage to us within [CHECK: damage reporting window]. This helps us put things right quickly. It does not reduce your rights if the goods are faulty.
7. Risk and ownership
The goods are our responsibility until they are delivered to you or to someone you have named to receive them, such as your builder. If you arrange your own carrier to collect the goods, they become your responsibility when we hand them to that carrier. Ownership of the goods passes to you when we have received payment in full.
8. Cancellation
If you bought online or otherwise at a distance, you may cancel within the period set by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. How to cancel, the items that cannot be cancelled, return arrangements and refunds are set out on our returns page, which forms part of these terms.
9. Faulty goods
We are under a legal duty to supply goods that are of satisfactory quality, fit for purpose and as described. Your rights if goods are faulty, including the right to reject within 30 days and the right to a repair or replacement, are summarised on our returns page and set out in full in the Consumer Rights Act 2015.
Please inspect every item before it is installed. A defect that could have been seen before fitting is much harder to put right once a piece is plumbed in and tiled around, and we ask you to report it before installation so it can be replaced without disturbing the room. [CHECK: position on removal and refitting costs, subject to legal review]
10. Colour, glaze and natural variation
Our ceramics are glazed and fired in a kiln. Each firing can differ slightly in shade, and matt and coloured glazes show this more than white. Slight differences in colour between pieces, and between a sample or screen image and the finished piece, are a characteristic of fired ceramics and are not a fault. To keep a colour consistent across a room, order all the pieces in one glaze at the same time.
Ceramics shrink in the kiln, so the dimensions of an individual piece can differ slightly from the stated size. [CHECK: dimensional tolerance for ceramics] Before a worktop is cut or tiles are set out around a piece, measure the piece itself rather than relying on the catalogue figure.
Brassware finishes such as gold and bronze can vary slightly between batches. Furniture made in timber will show natural variation in grain and colour, and timber moves with changes in humidity.
11. Installation
Unless we have agreed in writing to supply and fit, the goods will be installed by others. Installation should be carried out by a competent installer, following the fitting instructions and the Building Regulations, with electrical work done in line with BS 7671. We are not responsible for faults or damage caused by incorrect installation, or for the work of installers we did not appoint.
Where we supply and fit, the installation is covered by a separate quotation and terms. [CHECK: supply-and-fit terms]
12. Our liability to you
If we break these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or of our failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable. Loss is foreseeable if it is obvious that it will happen, or if both of us knew it might happen when the contract was made.
We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your legal rights in relation to the goods.
We supply goods for domestic and private use. If you use them for a commercial or business purpose, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.
13. Events outside our control
We are not responsible for delay or failure to perform caused by events outside our reasonable control. If such an event affects your order, we will contact you as soon as we can. If the delay is substantial, you may cancel and we will refund you for any goods you have paid for and not received.
14. Your personal information
We use your personal information only as described in our privacy policy.
15. Law and disputes
These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales. If you live in Scotland you can also bring proceedings in Scotland, and if you live in Northern Ireland you can also bring proceedings in Northern Ireland.
If you have a complaint, please contact us first through the contact page or on 01449 711782, so we can try to resolve it.
16. Changes to these terms
We may update these terms from time to time. The terms that apply to your order are those shown on the website when you placed it. These terms were last updated on [CHECK: date terms approved].
